Are you up to date with the new Companies (Trading Disclosures) Regulations 2008?

It may seem like a small matter in comparison to those other responsibilities you have when running your business; however, this often overlooked issue can have costly consequences for you personally as a Director or Secretary of your Company and for the Company itself.

 

You will be familiar with some of the requirements imposed on you such as the need for your registered name to appear on your letter heads, however, since 1st October 2008, this requirement has been extended to include, amongst others things, all notices and official publications, bills of exchange, cheques, orders for money, goods or services and all other business correspondence and documentation which also now includes email communications. In addition, you must display your registered name on your website.

 

You must also display your company number, the part of the United Kingdom where the company was registered i.e. England and Wales, Scotland or Northern Ireland, and the address of the registered office. These details must appear on all business letters, order forms and websites.

 

New rules also apply to displaying your registered name at your registered office.

 

Further requirements apply to certain kinds of companies such as investment companies.

 

The potential consequences for failing to comply with the Regulations are a fine of up to £1,000 and a further fine of up to £10 per day for each day of continued contravention.
