FAQs on legalities of dealing with bereavement


Who are Executors?

These are the people appointed in the Will to make sure everything in the Will is done. They must make the necessary applications for submission to the Probate Registry. We can help by preparing the necessary applications on behalf of the Executors. The Executors are legally liable for all that happens with the assets and monies.

 

Who are Administrators?

They are like Executors except they are the people who apply where the deceased has died intestate (without a Will). There are strict rules as to who is entitled to apply to be an Administrator. We can assist in preparing the application and advising as to who is the correct person to apply.

 

Will the Executors have to pay Inheritance Tax?

Inheritance Tax is payable where the "net value" of the estate is over a certain figure*. In such cases the Executors or Administrators have to complete a detailed form and send it to The Inland Revenue showing the deceased's assets and calculating the tax to be paid. We can prepare these forms for you. We can also deal with the Bank or Building Society to arrange for the payment of any Tax.

 

How do I know the value of the estate?

We will write on your behalf to the various Banks, Building Societies and insurance companies to obtain valuations. Where there are stocks and shares we will write to stockbrokers. Where there is property we can arrange for a professional valuation.

 

How are the beneficiaries paid?

When moneys are available we will arrange for payment of any specified money gifts and upon completion of the administration we will provide the Executors with full accounts for their approval. As soon as the Executors have approved these, we can arrange for all the other beneficiaries to be paid and the matter completed.
